Emotional Support Animal Law in California

For California residents, California Law AB 468, effective January 1, 2022, requires a 30-day client-provider relationship before an ESA letter can be issued. This translates to having two consultations before they can qualify for the necessary documentation, resulting in a longer timeline than the typical 24 hours.

What Do I Need to Know About ESA in California?

Fair Housing Act (FHA)

The Fair Housing Act protects your right to live with your Emotional Support Animal (ESA) in housing that typically doesn't allow pets. With an ESA letter, landlords must make reasonable accommodations for your animal, and they cannot charge you extra pet fees or deposits.

Air Carrier Access Act (ACAA)

The Air Carrier Access Act protects passengers with disabilities. Since 2021, airlines treat ESAs as pets and can no longer fly for free, so pet fees and carrier rules usually apply. Trained service dogs, including PSDs, still fly in the cabin for free.

Americans with Disabilities Act (ADA)

While the ADA primarily covers service animals, it's important to know that ESAs do not have the same public access rights. However, they do have specific protections in housing and, in some cases, air travel. Knowing the differences can help you navigate situations more effectively.

Emotional Support

An ESA offers companionship that can help reduce anxiety, depression, and feelings of loneliness. Their presence can create a calming environment and provide comfort during difficult times.

Stress Relief

Having an ESA can lower stress levels by offering unconditional love and support. Their companionship can lead to a more relaxed and stable emotional state, helping you manage daily stressors more effectively.

Social Interaction

ESAs can encourage more social interaction. Whether it's through meeting new people during walks or simply having a conversation starter, an ESA can help you feel more connected to others, which is beneficial for mental health.

Eligibility Requirements

To qualify for an ESA, you must have a diagnosed mental or emotional disability such as anxiety, depression, PTSD, or other conditions that substantially affect your daily life. A California-licensed mental health professional can determine if an ESA is right for your therapeutic needs.

Getting an ESA Letter

You need an official ESA letter from a licensed mental health professional to document your need for an emotional support animal. The letter must state that need and be on official letterhead with the provider’s signature and license number, so your landlord can easily verify that it’s genuine.

California's 30-Day Requirement

California Law AB-468, effective January 1, 2022, requires a minimum 30-day relationship with a California-licensed mental health professional before an ESA letter can be issued. This means you'll need an initial consultation, a 30-day waiting period, and a final evaluation, ensuring your letter is legitimate and legally compliant throughout California.

Your ESA Rights After HUD’s 2026 Update

On May 22, 2026, HUD pulled its older guidance that told landlords to treat ESAs as assistance animals. It now pursues complaints only for animals trained to perform specific tasks. But HUD only changed how it handles ESA complaints. It did not change the law, repeal the Fair Housing Act or cancel your letter. Your ESA letter is still valid, your state still protects you, and a properly issued letter from a licensed provider is still your best protection.

Your ESA letter remains valid if it’s from a licensed provider
Federal housing law hasn’t changed and still covers your ESA
Most states still protect ESAs
Trained service dogs are still covered
Private FHA lawsuits are still available
Existing court rulings on ESAs still apply

Frequently Asked Questions

California's AB-468 law, effective January 1, 2022, sets specific requirements for ESA documentation. Your ESA letter must come from a California-licensed mental health professional and include their license number, effective date, issuing jurisdiction, and professional license type. The provider must conduct a clinical evaluation, either in person or through telehealth, to assess whether an ESA would benefit your mental health. This law was designed to ensure ESA letters are legitimate and issued by qualified professionals who truly understand your needs.

Yes! ESA letters are legally recognized in California for housing under the Fair Housing Act. With a valid letter, landlords must allow your emotional support animal even in "no pets" buildings, and they cannot charge pet fees or deposits. However, ESA letters don't provide access to public spaces like restaurants, grocery stores, or shopping malls, those rights are reserved for trained service animals only. Airlines also changed their policies in 2021 and now treat ESAs as regular pets rather than service animals.

The process takes a minimum of 30 days in California. State law requires you to establish a genuine relationship with a licensed mental health professional before receiving your letter. This typically involves an initial consultation to discuss your emotional health needs, followed by a 30-day period, and then a final evaluation. While this timeline is longer than some other states, it ensures your documentation is legally compliant and will be accepted by California landlords and housing providers.

No, they're legally distinct. Service dogs receive extensive training to perform specific tasks, like detecting seizures, guiding the blind, or alerting to low blood sugar. This specialized training gives them access to virtually all public spaces under the ADA. ESAs work differently: they provide therapeutic comfort and emotional support through companionship, helping ease symptoms of anxiety, depression, PTSD, and other mental health conditions. While ESAs don't need formal training, they're still valuable for mental wellness and protected in housing situations.

Yes. Although HUD stopped enforcing complaints for untrained ESAs in May 2026, California has its own housing protections under the Fair Employment and Housing Act (FEHA), which recognizes support animals as a reasonable accommodation. That means California tenants can still request to live with their ESA, backed by a letter from a California-licensed provider. See what HUD’s policy change means.

Yes. AB 468 allows your clinical evaluation to take place through telehealth, so you can complete the entire process online with a California-licensed provider. You’ll have two consultations at least 30 days apart, and your letter is issued after the second one.
