What Do I Need to Know About ESA in Colorado?

Fair Housing Act (FHA)

The Fair Housing Act protects your right to live with your Emotional Support Animal (ESA) in housing that typically doesn't allow pets. With an ESA letter, landlords must make reasonable accommodations for your animal, and they cannot charge you extra pet fees or deposits.

Air Carrier Access Act (ACAA)

The Air Carrier Access Act protects passengers with disabilities. Since 2021, airlines treat ESAs as pets and can no longer fly for free, so pet fees and carrier rules usually apply. Trained service dogs, including PSDs, still fly in the cabin for free.

Americans with Disabilities Act (ADA)

While the ADA primarily covers service animals, it's important to know that ESAs do not have the same public access rights. However, they do have specific protections in housing and, in some cases, air travel. Knowing the differences can help you navigate situations more effectively.

Emotional Support

An ESA offers companionship that can help reduce anxiety, depression, and feelings of loneliness. Their presence can create a calming environment and provide comfort during difficult times.

Stress Relief

Having an ESA can lower stress levels by offering unconditional love and support. Their companionship can lead to a more relaxed and stable emotional state, helping you manage daily stressors more effectively.

Social Interaction

ESAs can encourage more social interaction. Whether it's through meeting new people during walks or simply having a conversation starter, an ESA can help you feel more connected to others, which is beneficial for mental health.

Eligibility Requirements

To qualify for an ESA, you must have a diagnosed mental or emotional disability such as anxiety, depression, PTSD, or other conditions that substantially affect your daily life. A Colorado-licensed mental health professional can determine if an ESA is right for your therapeutic needs.

Getting an ESA Letter

You need an official ESA letter from a licensed mental health professional to document your need for an emotional support animal. The letter must state that need and be on official letterhead with the provider’s signature and license number, so your landlord can easily verify that it’s genuine.

Colorado ESA Consultation Laws

Colorado requires a bona fide provider-patient relationship before issuing ESA letters. Mental health professionals (therapists, counselors, social workers) & nurses must meet with you in person under C.R.S. 12-245-229 & C.R.S. 12-255-133. Only physicians may conduct online evaluations under C.R.S. 12-240-144, ensuring your ESA letter is legitimate and legally compliant.

Your ESA Rights After HUD’s 2026 Update

On May 22, 2026, HUD pulled its older guidance that told landlords to treat ESAs as assistance animals. It now pursues complaints only for animals trained to perform specific tasks. But HUD only changed how it handles ESA complaints. It did not change the law, repeal the Fair Housing Act or cancel your letter. Your ESA letter is still valid, your state still protects you, and a properly issued letter from a licensed provider is still your best protection.

Your ESA letter remains valid if it’s from a licensed provider
Federal housing law hasn’t changed and still covers your ESA
Most states still protect ESAs
Trained service dogs are still covered
Private FHA lawsuits are still available
Existing court rulings on ESAs still apply

Getting an ESA letter in Colorado is straightforward with WellnessWag. Start by completing our online assessment to share your mental health needs. We'll then connect you with a Colorado-licensed healthcare provider for a consultation to evaluate whether an ESA would benefit your condition. Once approved, you'll receive your official ESA letter on professional letterhead with all required license details. Note that Colorado requires mental health professionals to conduct in-person evaluations, while physicians may use online consultations.

Colorado recognizes ESAs under federal Fair Housing Act protections for housing accommodations. Unlike service animals, ESAs don't have automatic access to public spaces like restaurants, stores, or shopping centers, though some businesses voluntarily allow them. Airlines also changed their policies in 2021 and now treat ESAs as regular pets rather than service animals. For workplace accommodations, it's best to discuss your needs with your employer, as ESAs aren't federally protected in employment settings like trained service dogs are.

The primary distinction between an emotional support animal (ESA) in Colorado and a service animal lies in their intended purpose and training. Service animals undergo intensive training to perform specific tasks directly assisting individuals with disabilities, such as guiding the visually impaired or alerting to seizures. In contrast, ESAs in Colorado do not require specialized training. Their primary role is to provide emotional support, alleviate symptoms of mental or emotional disabilities, and offer comfort to their owners. Licensed mental health professionals prescribe ESAs based on the therapeutic benefits they provide.

Colorado landlords must accept legitimate ESA letters under the Fair Housing Act, allowing you to live with your emotional support animal even in "no pets" housing. Your ESA is protected as a reasonable accommodation for your disability, and landlords cannot charge pet fees or deposits. In rare cases, housing providers may request additional documentation if the animal is unusually large, exotic, or if your disability isn't apparent. As long as your ESA letter comes from a licensed Colorado provider and your animal doesn't pose safety concerns, you're entitled to housing protections.

Your ESA letter is still valid, and you can still ask your landlord to accommodate your ESA. HUD stopped enforcing complaints for untrained ESAs in May 2026, but the Fair Housing Act itself didn't change. Colorado's own housing laws now play a larger part in how your request is protected. See what HUD's policy change means.

Yes, when your evaluation is with a physician. Under Colorado law, licensed mental health professionals must meet with you in person before recommending an ESA, while physicians can evaluate you through telemedicine. Once a Colorado-licensed physician approves you online, your letter arrives by email.
