What Do I Need to Know About ESA in Florida?

Fair Housing Act (FHA)

The Fair Housing Act protects your right to live with your Emotional Support Animal (ESA) in housing that typically doesn't allow pets. With an ESA letter, landlords must make reasonable accommodations for your animal, and they cannot charge you extra pet fees or deposits.

Air Carrier Access Act (ACAA)

The Air Carrier Access Act protects passengers with disabilities. Since 2021, airlines treat ESAs as pets and can no longer fly for free, so pet fees and carrier rules usually apply. Trained service dogs, including PSDs, still fly in the cabin for free.

Americans with Disabilities Act (ADA)

While the ADA primarily covers service animals, it's important to know that ESAs do not have the same public access rights. However, they do have specific protections in housing and, in some cases, air travel. Knowing the differences can help you navigate situations more effectively.

Emotional Support

An ESA offers companionship that can help reduce anxiety, depression, and feelings of loneliness. Their presence can create a calming environment and provide comfort during difficult times.

Stress Relief

Having an ESA can lower stress levels by offering unconditional love and support. Their companionship can lead to a more relaxed and stable emotional state, helping you manage daily stressors more effectively.

Social Interaction

ESAs can encourage more social interaction. Whether it's through meeting new people during walks or simply having a conversation starter, an ESA can help you feel more connected to others, which is beneficial for mental health.

Eligibility Requirements

To qualify for an ESA, you must have a diagnosed mental or emotional disability such as anxiety, depression, PTSD, or other conditions that substantially affect your daily life. A Florida-licensed mental health professional can determine if an ESA is right for your therapeutic needs.

Getting an ESA Letter

You need an official ESA letter from a licensed mental health professional to document your need for an emotional support animal. The letter must state that need and be on official letterhead with the provider’s signature and license number, so your landlord can easily verify that it’s genuine.

Florida's Consultation Requirements

Florida requires healthcare providers to have genuine knowledge of your condition before issuing ESA documentation, but there's no mandatory waiting period. You can complete your entire evaluation via online consultations with licensed professionals and receive your letter quickly, ensuring your documentation is both legitimate and legally compliant throughout Florida.

Your ESA Rights After HUD’s 2026 Update

On May 22, 2026, HUD pulled its older guidance that told landlords to treat ESAs as assistance animals. It now pursues complaints only for animals trained to perform specific tasks. But HUD only changed how it handles ESA complaints. It did not change the law, repeal the Fair Housing Act or cancel your letter. Your ESA letter is still valid, your state still protects you, and a properly issued letter from a licensed provider is still your best protection.

Your ESA letter remains valid if it’s from a licensed provider
Federal housing law hasn’t changed and still covers your ESA
Most states still protect ESAs
Trained service dogs are still covered
Private FHA lawsuits are still available
Existing court rulings on ESAs still apply

Frequently Asked Questions

No, you don't have to pay pet rent, pet fees, or pet deposits for your ESA in Florida. Under the Fair Housing Act and Florida Statute 760.27, your emotional support animal is not considered a pet but rather a reasonable accommodation for your disability. Landlords cannot charge extra fees for ESAs, though you remain responsible for any damage your animal causes to the property.

While Florida law doesn't specify an expiration date for ESA letters, most housing providers and industry standards recommend renewing your letter annually. This ensures your documentation remains current and that your ongoing need for an ESA is properly documented. An annual renewal also helps prevent landlords from questioning the validity of your letter and ensures your provider can confirm your continued therapeutic need for your emotional support animal.

Florida landlords must accept legitimate ESA letters under state and federal law. However, they may deny your ESA if the animal poses a direct threat to safety or health, would cause significant property damage, or creates an undue financial burden. Landlords can request documentation from your licensed mental health professional but cannot ask for details about your diagnosis or medical records. Your letter must comply with Florida law, meaning it comes from a provider with genuine knowledge of your condition.

Service animals are trained to perform specific tasks for people with disabilities and have public access rights under the ADA, allowing them into restaurants, stores, and most public places. Emotional support animals provide therapeutic comfort through their presence but don't require specialized training. In Florida, ESAs are protected in housing under the Fair Housing Act but don't have the same public access rights as service animals. The key distinction is training and access: service animals are trained for tasks and go everywhere, while ESAs provide emotional support and are primarily protected in housing.

Florida renters can still ask to live with their ESA. HUD stopped enforcing complaints for untrained ESAs in May 2026, but the Fair Housing Act didn't change and your letter is still valid. Florida's own housing laws now play a bigger role in protecting your request. See what HUD's policy change means.

Yes, as long as it comes from a Florida-licensed provider after a real evaluation. Telehealth evaluations are allowed in Florida, and there's no waiting period, so you can receive your letter in as little as 24 hours.
