What Do I Need to Know About ESA in Hawaii?

Fair Housing Act (FHA)

The Fair Housing Act protects your right to live with your Emotional Support Animal (ESA) in housing that typically doesn't allow pets. With an ESA letter, landlords must make reasonable accommodations for your animal, and they cannot charge you extra pet fees or deposits.

Air Carrier Access Act (ACAA)

The Air Carrier Access Act protects passengers with disabilities. Since 2021, airlines treat ESAs as pets and can no longer fly for free, so pet fees and carrier rules usually apply. Trained service dogs, including PSDs, still fly in the cabin for free.

Americans with Disabilities Act (ADA)

While the ADA primarily covers service animals, it's important to know that ESAs do not have the same public access rights. However, they do have specific protections in housing and, in some cases, air travel. Knowing the differences can help you navigate situations more effectively.

Emotional Support

An ESA offers companionship that can help reduce anxiety, depression, and feelings of loneliness. Their presence can create a calming environment and provide comfort during difficult times.

Stress Relief

Having an ESA can lower stress levels by offering unconditional love and support. Their companionship can lead to a more relaxed and stable emotional state, helping you manage daily stressors more effectively.

Social Interaction

ESAs can encourage more social interaction. Whether it's through meeting new people during walks or simply having a conversation starter, an ESA can help you feel more connected to others, which is beneficial for mental health.

Eligibility Requirements

To qualify for an ESA, you must have a diagnosed mental or emotional disability such as anxiety, depression, PTSD, or other conditions that substantially affect your daily life. A mental health professional licensed in Hawaii can determine if an ESA is right for your therapeutic needs

Getting an ESA Letter

You need an official ESA letter from a licensed mental health professional to document your need for an emotional support animal. The letter must state that need and be on official letterhead with the provider’s signature and license number, so your landlord can easily verify that it’s genuine.

Professional Consultation

To obtain an ESA letter, you'll need to consult with a licensed therapist, psychologist, or psychiatrist. They will evaluate your condition and determine if an ESA can provide therapeutic benefits. This consultation can often be done online, making the process convenient and accessible.

Your ESA Rights After HUD’s 2026 Update

On May 22, 2026, HUD pulled its older guidance that told landlords to treat ESAs as assistance animals. It now pursues complaints only for animals trained to perform specific tasks. But HUD only changed how it handles ESA complaints. It did not change the law, repeal the Fair Housing Act or cancel your letter. Your ESA letter is still valid, your state still protects you, and a properly issued letter from a licensed provider is still your best protection.

Your ESA letter remains valid if it’s from a licensed provider
Federal housing law hasn’t changed and still covers your ESA
Most states still protect ESAs
Trained service dogs are still covered
Private FHA lawsuits are still available
Existing court rulings on ESAs still apply

Frequently Asked Questions

Getting your Hawaii ESA letter with Wellness Wag starts with our simple online assessment. Tell us about your emotional support needs, and we'll pair you with a licensed mental health professional in Hawaii for a thorough evaluation. Hawaii doesn't require waiting periods or special relationship mandates, so the timeline is flexible and fast. After your provider confirms an ESA would help your mental health condition, you'll receive your official letter on professional letterhead, granting you housing rights to live with your ESA without pet fees or deposits.

No, Hawaii doesn't require ESA registration. There's no official registry recognized by state or federal law. The only legitimate documentation you need is an ESA letter from a Hawaii-licensed mental health professional. Your ESA letter alone provides all the housing protections you need under the Fair Housing Act.

No, ESAs don't have automatic public access rights in Hawaii. Unlike trained service animals, emotional support animals cannot accompany you into restaurants, stores, or other public accommodations. Your ESA's protections apply specifically to housing. However, many Hawaii businesses are pet-friendly and welcome well-behaved animals. Call ahead to ask about their policies. Your ESA has strong housing rights, just not the broad public access that service animals enjoy.

Wellness Wag letters are issued by licensed mental health professionals in Hawaii after thorough clinical evaluations. Each letter includes all legally required elements: professional letterhead, provider's signature, license number, and confirmation of your disability-related need. We never issue letters without proper evaluation, ensuring your documentation is legally valid and complies with Fair Housing Act requirements.

You can still ask to live with your ESA in Hawaii, and your letter remains valid. HUD stopped enforcing complaints for untrained ESAs in May 2026, but the Fair Housing Act itself is unchanged. Hawaii's own housing laws now play a larger role in protecting your request. See what HUD's policy change means.

Yes, from any island. Hawaii allows telehealth evaluations and has no waiting period, so you can meet with a Hawaii-licensed provider online and, if you qualify, receive your letter in as little as 24 hours.
