Get Your ESA Letter in Any New York City

We’ve listed a few of our most popular cities below, but no matter where you live, Wellness Wag connects you with licensed professionals who make the ESA letter process quick, easy, and full of care.

What Do I Need to Know About ESA in New York?

Fair Housing Act (FHA)

The Fair Housing Act protects your right to live with your Emotional Support Animal (ESA) in housing that typically doesn't allow pets. With an ESA letter, landlords must make reasonable accommodations for your animal, and they cannot charge you extra pet fees or deposits.

Air Carrier Access Act (ACAA)

The Air Carrier Access Act protects passengers with disabilities. Since 2021, airlines treat ESAs as pets and can no longer fly for free, so pet fees and carrier rules usually apply. Trained service dogs, including PSDs, still fly in the cabin for free.

Americans with Disabilities Act (ADA)

While the ADA primarily covers service animals, it's important to know that ESAs do not have the same public access rights. However, they do have specific protections in housing and, in some cases, air travel. Knowing the differences can help you navigate situations more effectively.

Emotional Support

An ESA offers companionship that can help reduce anxiety, depression, and feelings of loneliness. Their presence can create a calming environment and provide comfort during difficult times.

Stress Relief

Having an ESA can lower stress levels by offering unconditional love and support. Their companionship can lead to a more relaxed and stable emotional state, helping you manage daily stressors more effectively.

Social Interaction

ESAs can encourage more social interaction. Whether it's through meeting new people during walks or simply having a conversation starter, an ESA can help you feel more connected to others, which is beneficial for mental health.

Eligibility Requirements

To qualify for an ESA, you must have a diagnosed mental or emotional disability such as anxiety, depression, PTSD, or other conditions that substantially affect your daily life. A New York-licensed mental health professional can determine if an ESA is right for your therapeutic needs.

Getting an ESA Letter

You need an official ESA letter from a licensed mental health professional to document your need for an emotional support animal. The letter must state that need and be on official letterhead with the provider’s signature and license number, so your landlord can easily verify that it’s genuine.

Professional Consultation

To obtain an ESA letter, you'll need to consult with a licensed therapist, psychologist, or psychiatrist. They will evaluate your condition and determine if an ESA can provide therapeutic benefits. This consultation can often be done online, making the process convenient and accessible.

Your ESA Rights After HUD’s 2026 Update

On May 22, 2026, HUD pulled its older guidance that told landlords to treat ESAs as assistance animals. It now pursues complaints only for animals trained to perform specific tasks. But HUD only changed how it handles ESA complaints. It did not change the law, repeal the Fair Housing Act or cancel your letter. Your ESA letter is still valid, your state still protects you, and a properly issued letter from a licensed provider is still your best protection.

Your ESA letter remains valid if it’s from a licensed provider
Federal housing law hasn’t changed and still covers your ESA
Most states still protect ESAs
Trained service dogs are still covered
Private FHA lawsuits are still available
Existing court rulings on ESAs still apply

Frequently Asked Questions

Woman hugging her emotional support dog

Start with our quick online assessment at Wellness Wag. We'll match you with a New York-licensed mental health professional for your evaluation. New York has no state-specific requirements or waiting periods, making the process simple and accessible. Once your provider determines an ESA would benefit your mental health, you'll receive your official letter on professional letterhead. This gives you the right to live with your ESA without extra fees, protected under both federal Fair Housing Act and New York State Human Rights Law.

New York follows federal Fair Housing Act protections with additional state-level support through the New York State Human Rights Law. There are no waiting period requirements. In August 2020, New York passed legislation strengthening protections for ESA owners in housing. Landlords must provide reasonable accommodations, and you're protected from discrimination. Remember: housing protection only, not workplace or public spaces. New York also prohibits misrepresenting pets as service animals under Agriculture & Markets Law § 118(1).

Not if you have a legitimate ESA letter. New York law requires landlords to accommodate your emotional support animal as part of your disability needs. They can request your letter and, for dogs, proof of vaccination as required by state law. However, they can't demand diagnosis details or charge pet-related fees. The only exceptions are if your animal poses safety threats, causes property damage, or creates undue hardship for the housing provider.

The main difference between an emotional support animal (ESA) in New York and a service animal lies in their training and legal rights. ESAs provide emotional support and comfort to individuals with mental health conditions and are protected under the Fair Housing Act, allowing them to reside in housing with "no pets" policies. Service animals, on the other hand, are trained to perform specific tasks related to a person's disability and are protected under the Americans with Disabilities Act (ADA), granting them access to public places. It's important to note that while service animals have broader public access rights, ESAs have specific housing-related protections.

Yes. New York tenants can still request to live with their ESA as a reasonable accommodation, and a letter from a licensed provider remains valid. HUD only changed how it enforces complaints for untrained ESAs in May 2026, and the Fair Housing Act is unchanged. New York's housing laws now matter more in how your request is handled. See what HUD's policy change means.

Yes, as long as it comes from a New York-licensed provider after a real evaluation. Telehealth evaluations are allowed with no waiting period, so you can receive your letter in as little as 24 hours.
