What Do I Need to Know About ESA in Washington?

Fair Housing Act (FHA)

The Fair Housing Act protects your right to live with your Emotional Support Animal (ESA) in housing that typically doesn't allow pets. With an ESA letter, landlords must make reasonable accommodations for your animal, and they cannot charge you extra pet fees or deposits.

Air Carrier Access Act (ACAA)

The Air Carrier Access Act protects passengers with disabilities. Since 2021, airlines treat ESAs as pets and can no longer fly for free, so pet fees and carrier rules usually apply. Trained service dogs, including PSDs, still fly in the cabin for free.

Americans with Disabilities Act (ADA)

While the ADA primarily covers service animals, it's important to know that ESAs do not have the same public access rights. However, they do have specific protections in housing and, in some cases, air travel. Knowing the differences can help you navigate situations more effectively.

Emotional Support

An ESA offers companionship that can help reduce anxiety, depression, and feelings of loneliness. Their presence can create a calming environment and provide comfort during difficult times.

Stress Relief

Having an ESA can lower stress levels by offering unconditional love and support. Their companionship can lead to a more relaxed and stable emotional state, helping you manage daily stressors more effectively.

Social Interaction

ESAs can encourage more social interaction. Whether it's through meeting new people during walks or simply having a conversation starter, an ESA can help you feel more connected to others, which is beneficial for mental health.

Eligibility Requirements

To qualify for an ESA, you must have a diagnosed mental or emotional disability such as anxiety, depression, PTSD, or other conditions that substantially affect your daily life. A Washington-licensed mental health professional can determine if an ESA is right for your therapeutic needs.

Getting an ESA Letter

You need an official ESA letter from a licensed mental health professional to document your need for an emotional support animal. The letter must state that need and be on official letterhead with the provider’s signature and license number, so your landlord can easily verify that it’s genuine.

Professional Consultation

To obtain an ESA letter, you'll need to consult with a licensed therapist, psychologist, or psychiatrist. They will evaluate your condition and determine if an ESA can provide therapeutic benefits. This consultation can often be done online, making the process convenient and accessible.

Your ESA Rights After HUD’s 2026 Update

On May 22, 2026, HUD pulled its older guidance that told landlords to treat ESAs as assistance animals. It now pursues complaints only for animals trained to perform specific tasks. But HUD only changed how it handles ESA complaints. It did not change the law, repeal the Fair Housing Act or cancel your letter. Your ESA letter is still valid, your state still protects you, and a properly issued letter from a licensed provider is still your best protection.

Your ESA letter remains valid if it’s from a licensed provider
Federal housing law hasn’t changed and still covers your ESA
Most states still protect ESAs
Trained service dogs are still covered
Private FHA lawsuits are still available
Existing court rulings on ESAs still apply

Frequently Asked Questions

Washington follows federal Fair Housing Act guidelines for emotional support animals. To qualify, you need a valid ESA letter from a licensed mental health professional stating you have a disability that benefits from an emotional support animal. There are no state-specific waiting periods or additional consultation requirements, and any domesticated animal can qualify as an ESA as long as it doesn't pose a threat to others or cause property damage.

Landlords in Washington must accept emotional support animals when you provide a valid ESA letter from a licensed mental health professional. Under the Fair Housing Act, landlords cannot enforce no-pet policies against ESA owners or reject your request based on breed, size, or weight restrictions. However, landlords can deny an ESA under limited circumstances. These include situations where the specific animal poses a direct threat to the health or safety of others, or would cause substantial property damage that cannot be reduced through other means.

ESA letters in Washington are typically valid for 12 months from the date of issue. After this period, you'll need to renew your documentation with a licensed mental health professional to continue receiving housing protections. Keeping your letter current ensures landlords recognize your ESA accommodations without issue.

No. Under the Fair Housing Act, landlords in Washington cannot charge pet deposits, pet rent, or any additional fees for emotional support animals. ESAs are classified as assistance animals rather than pets, so standard pet policies don't apply. However, you remain responsible for covering the cost of any damage your ESA causes to the property.

Yes, you can still request it. HUD stopped enforcing complaints for untrained ESAs in May 2026, but your letter remains valid and the Fair Housing Act is unchanged. Washington tenants can still ask for their ESA as a reasonable accommodation, with state law now playing a bigger part. See what HUD's policy change means.

No. Washington allows your evaluation to take place by telehealth, with no waiting period. Meet with a Washington-licensed provider online, and once approved, receive your letter in as little as 24 hours.
